The following Terms of Use and Privacy Policy (“Terms”) between you (“you”, “your”) and Creative Startups, LLC d/b/a “Next” ("Next”, “we” "us," or "our"), describe the terms and conditions on which you may access and use Next’s website located at www.next.lookguilty.com, (the “Website”), and related services including Next’s styling and purchase services (together with the Website, the “Services”). By accessing or using any of the Services, you acknowledge that you have read, understood and agreed to be bound by these Terms.

Next works to ensure your privacy is protected when using the Services. We therefore have a policy setting out how your personal data will be processed and protected. Any changes we have made to this data policy can be found by visiting the Website.

Personal Details. We assume responsibility for all the personal data – such as your name, address, e-mail address, telephone - that we obtain when you order or create an account at the Website. We have put in place physical, electronic, contractual, and managerial safeguards to protect the security and privacy of your personal information. When you enter your personal information to the Website we use technology to protect your information as it is transmitted to Us.

Registration. In order to use some features of the Website and/or the Services, you are required to register and create a username and password. We use this information to contact you in regards to the Services on our Website to which you have signed-in to.

Personal Information. Except in the limited circumstances described in this Terms, we do not share Personal Information with any external parties. We may use your information to send you offers and deals that we believe would be interesting to you based on the demographic and geographic data that you have provided Us. Any information that you voluntarily choose to display on any publicly available portion of the Website, our social media channels, or your own by tagging Guilty, may be collected and used by us. Next keeps Personal Information no longer than necessary for legitimate business purposes or as required by law.

Surveys or Contests on Social Media, Email or Website. Next may offer its members (“Members”) the opportunity to participate in surveys or contests on its social media channels, Website or via email. If you participate, you voluntarily provide your own Personal Information and authorize use of that in the manner Next deems essential. By participating in a survey or contest, you agree to that activity’s terms and conditions, including providing us with permission, if required, to share your Personal Information with sponsors of that survey and/or contest, as applicable. Next, in several cases, may use third party service providers to conduct these surveys or contests, in which case the third party's service providers' use of Member’s Personal Information will be governed by their own privacy policy.

Refer a friend campaign. From time to time, we may offer Members the ability to refer friends within and outside their networks through email, social media channels and through the Website. If you choose to participate in this, you may be required to provide your friend’s name and email address. We will automatically send your friend a one-time email inviting her to visit the Website. Next stores this information for the sole purpose of sending emails and tracking the success of this referral program. You or your friend may contact us to request that we remove this information from our database.

Reviews. If you choose to post a review or leave feedback for other Members, please note that such information is available to anyone with Internet access. PLEASE BE CAREFUL WHEN DISCLOSING ANY INFORMATION IN PUBLIC POSTING AREAS. WE ARE NOT RESPONSIBLE FOR THE USE BY OTHERS OF THE INFORMATION YOU PUBLICLY DISCLOSE.

Content: If you post, upload or make available to Next or the Services, or otherwise submit to the Website, Next social media, or other platform of similar nature, any information, data, text, images, files, links, software, chat, communication or other materials, including but not limited to photos and reviews relating to your use of the Website and/or Services (“Your Content”), You hereby grant to Next a perpetual, non-exclusive, irrevocable, fully-paid, royalty-free, sub-licensable and transferable (in whole or part) worldwide license to use, reproduce, transmit, display, exhibit, distribute, index, comment on, modify, create derivative works based upon, perform and otherwise exploit Your Content and Your name, image, voice, likeness and/or other biographical information or material in connection with Your Content, in whole or in part, in all media formats and distribution methods now known or hereafter devised (including on the Website, social media, in email and other promotional campaigns and on third party sites promoting the Website and/or Services) in connection with the Website and/or the Services, including but not limited to, advertising, promoting, and marketing the Services, all without further notice to you, with or without attribution, without limitation as to frequency, and without the requirement of any permission from or payment to you or to any other person or entity. You waive any right to inspect or approve any of Your Content or any use of Your Content. By submitting Your Content, you represent and warrant that Your Content and your communication thereof conform to these Terms and that you own or have the necessary rights, licenses, consents and permissions, without the need for any permission from or payment to any other person or entity, to exploit, and to authorize Next to exploit, Your Content in all manners contemplated by these Terms. You waive all moral rights in Your Content which may be available to you and confirm that no such rights have been asserted. None of Your Content will be subject to any obligation, whether of confidentiality, attribution or otherwise, on our part and we will not be liable for any use or disclosure of any Your Content.

Third parties. Next, in several cases, may use third party service providers to conduct the Services, in which case the third party's service providers' use of Member’s Personal Information will be governed by their own privacy policy.

Sign-up process. During the sign-up process at the Website, we may require you to provide your Personal Information in accordance with our Terms. We use this information to contact you about the Services. By using the Website and by giving us your Personal information as requested in the forms, you agree to indemnify, hold harmless and defend Next and its officers, directors, agents and affiliates from any claims, damages, losses, liabilities, and all costs and expenses of defense, including but not limited to, attorneys' fees, resulting directly or indirectly from a claim by a third party that is based on your use of the Website in violation of these terms. The Website and all related web pages, social platforms, including any blogs or other related sites, that are the property of Next, are available for consumers globally to browse without revealing your identity or providing any specific Personal Information about you. However, once you provide us your Personal Information, you understand that we may track your behavior and movements on the Website and we may use this information for internal research on users’ behavior, demographics, interests, to better understand, protect and service customers or potential customers. We only collect Personal Information about you that we consider necessary for making your experience with Next a much more personalized one.

You waive any right to inspect or approve any Content or any use of the Content. By submitting Content, you represent and warrant that you own or have the necessary rights, licenses, consents and permissions, without the need for any permission from or payment to any other person or entity, to exploit, and to authorize us to exploit, such Content in all manners contemplated by these terms and conditions. You waive all moral rights in the Content which may be available to you and confirm that no such rights have been asserted.
